The requirements stem from the 2014 Consolidated Appropriations Act and mandate that iron and steel products used in projects for the construction, alteration, maintenance, or repair of public water systems or treatment works and funded by specific state revolving funds (SRF) must be produced in the United States. This provision is a permanent requirement for all Clean Water State Revolving Fund (CWSRF), Drinking Water State Revolving Fund (DWSRF), and Water Infrastructure Finance and Innovation Act (WIFIA) projects. Projects funded by USDA Rural Utilities Service (RUS) Water and Environmental Programs (WEP), the AIS requirement applies to projects for the construction, alteration, maintenance, or repair of water and waste infrastructure.
Requirements are enforced by state and federal agencies, including the Environmental Protection Agency (EPA) and state environmental departments. Compliance documentation, such as certification letters, must be included in project documentation, and specific language should be included in contracts to ensure adherence to AIS requirements.
